Recreational Cannabis Regulations

Officer LanuteOn January 1, 2020, Illinois became the 11th state to legalize the recreational use of marijuana (cannabis). The Illinois Cannabis Regulation and Tax Act of 2019 permits anyone 21 years of age or older to purchase marijuana and cannabis infused products from state authorized dispensaries. Before the passing of this legislation, the use of marijuana was only permitted to those for medicinal purposes.

While recreational cannabis is now legal, residents must remember that many regulations still exist on the lawful use, possession and transportation of these products.

Under the new law, anyone allowed to purchase marijuana or cannabis infused products may have up to 30 grams, or just about one ounce of cannabis flower. Additionally, users must obey the same restrictions established for the usage of tobacco and tobacco products. This means that like tobacco, persons under the age of 21 cannot purchase, use or possess marijuana or cannabis infused products and no one can use them in any public place (streets or parks).  

Additionally, the state has created regulations to help protect young people from these products.  Marijuana or cannabis infused products cannot be used around any person under the age of 21.

When transporting marijuana or cannabis infused products purchased from an authorized dispensary, they must be in a SEALED, ODOR-PROOF and CHILD RESISTANT container. Cannabis sold by authorized dispensaries will come in these specialized containers. Marijuana and cannabis infused products must not be accessible while in transport.

If you choose to use marijuana or cannabis infused products under the new law in Illinois, we at the Huntley Police Department encourage you to be safe, follow the guidelines under the statute and to not drive under the influence of ANY impairing substance.
